Satellite Earth Station E040144 Renewal of License Request for Waiver Due to Timing of Renewal Submission The Board of Governors of Missouri State University (the “University”) respectfully requests waiver of Section 25.121 of the FCC’s rules with respect to the timing of the submission of this license renewal application for domestic fixed satellite receive-only earth station E040144. The University originally applied to register this C-band receive-only satellite earth station in 2004, in FCC File No. SES-REG-20040312-00371, in connection with distribution of public radio programming for the University’s noncommercial educational FM radio station KSMU(FM), Springfield, Missouri, FCC Facility ID 4210. The FCC granted the earth station registration on April 27, 2004, under call sign E040144, with a registration expiration date of March 12, 2019. Although this renewal application is being filed before the March 12, 2019 expiration date for the E040144, it is not filed more than 30 days before the expiration date as prescribed by Section 25.121(e) of the rules. The University therefore respectfully requests the FCC’s indulgence for the lateness of this renewal submission and requests processing at this time. The tardiness of the submission is likely a result of the length of time since the original registration of this authorization, and the lack of involvement at that time by current station staff and outside representatives to track the resulting renewal deadline. The University submits that acceptance and processing of this renewal application will greatly serve the public interest, convenience and necessity by allowing the continued use of this facility in connection with the provision of noncommercial educational broadcast programming over station KSMU(FM). Moreover, the University’s outside legal counsel will now add this earth station registration and its deadline into its electronic tracking database to assist the University with monitoring this station and its filing requirements going forward. 1
