DC 20554 Re: Pettition for Reconsideration of Notice of Dismissal License Renewal for E7107 File No: SES—RWL—20060209—00218 Dear Secretary: Background: On April 14, 2006, our application for rerewal of E7107 was dismissed due to a "payment red—line" relating to another license, E6318, which had been dismanfied on May 15, 2005 in order to move the transmitter system to be installed at a newthird licensed location, ref: EO50083. E6318 had been surrendered by letter to the commission, dated September 15, 2005, later than anticipated due to hurricane Katrina in August 2005, and further, such surrender of authorization was not recognized until October 4, 2005, after the October 1" cutoff for annual administrative fee purposes, causing the financial "red—line" to appear when the renewal for E7107 was submitted in February 2007. Basis for Pettition for Reconsideration: Although the surrender of authorization was not recognized until October 4, 2005, the earth station license was automatically terminated August 15, 2005, 90 days after its dismantling on May 15, 2005, persuant to FCC rules 47 CFR. Section 25.161(c), Automatic termination of station authorization: (for) "The removal or modification of the facilities which renders the station not operational for more than 90 days, ..." As such, the ficense was non—existant on October 1, 2005; the annual administrative fee was not applicable, and the dismissal of our renewal application should thereby respectfully be reconsidered, and the renewal of E7107 should be granted under the commission‘s rules.
