Dortch, Secretary ATTN: International Bureau, Satellite Division PETITION FOR REINSTATEMENT Pursuant to Section 25.163 of the Commission’s rules, 47 CFR 5 25.163, Metropolitan Indianapolis Public Broadcasting, Inc. (d/b/a WFYI TV Channel 20) (“MIPB”), hereby respectfully requests the Satellite Division of the International Bureau to reinstate the license of WD72, a fixed earth station previously licensed to MIPB and utilized in connection with operation of Noncommercial Education Station WFYI (TV). MIPB was granted the WD72 authorization on September 4, 1998. The authorization covered a ten year period starting in 1998 and expired by its terms on September 16, 2008. This Petition for Reinstatement is being filed within 30 days after that expiration date and thus falls within the time period specified in Section 25.163(a)(l). MIPB, until few days ago, was unaware that the WD72 license had expired. It discovered

that it had overlooked the expiration date during a general review of the station's compliance with the FCC's rules and policies. MIPB is a responsible public broadcaster and makes every effort to follow all Commission requirements -- as evidenced by its voluntary general review of its regulatory compliance that brought the expiration of the WD72 license to light. MIPB missed the license renewal date because the ten year licensing period gave them a false sense of security but to prevent this occurring in the future, M P B has instituted a computer-based "tickler" system to ensure that future renewal and other deadlines are noted and met. MIPB's Vice-president for Broadcast Operations will monitor the tickler system. Significantly, MIPB has not used the earth station since the expiration date' and does not intend to do so until the authorization is reinstated. Thus, although the authorization expired on September 16, 2008, WD72 has not been operated without authorization nor will it be. ' See Exhibit A hereto (logs regarding operation of the earth station) showing that it was last used August 2 1,2008. 2

In conclusion, MIPB utilizes this earth station in providing its public broadcasting service. Its failure to file the WD72 renewal application in a timely manner was inadvertent. MIPB has developed a tickler system to ensure future compliance with deadlines.
