The Bureau gave public notice of such dismissalby release on September 21, 2005 ofa Notice of Dismissal dated that same date (DA 05—2488). Therefore this Petition for Reconsideration is timely pursuant to sections 1.4 and 1106(ofthe Commission‘s Rules. Freedom filed the Application on May 23, 2005. ‘The Commission‘s Office ofthe Managing Director subsequently notified Freedom by letter dated May 24, 2005, that Freedom allegedly was delinguent on the payment of a debt owed to the Commission in the amount of $26,656.25. On September 21, 2005, pursuant to the Notice of Dismissal, the Intemational Bureau notified Freedom that the Commission had not received payment of the debt,and that the Application was therefore being dismissed pursuant to section 1.1910(b)(3) ofthe Commission‘s Rules. powisna

The debt purportedly owed by Freedom to the Commission relates to 2001 annual regulatory fees in the amount of $21,325.00 for Freedom‘s station WWMT—TV (Facility ID 74195).‘. Freedom fully and timely paid these fees in 2001. In response to prior inquiries, Freedom has notified the Commission no fewer than three times that such payment was made in full, and has supplied the Commission with ample written documentation of such payment.\ Despite thase repeated attempts to resolve the Commission‘s inguiries on this matter, Freedom has not received a response from the Commission. The documentation attached to this Petition, which previously has been provided to the Commission, adequately demonstrates that Freedom has no debt for 2001 regulatory fees outstanding. Thus, Freedom submits thatits Application, which should have been granted in the ordinary course, was wrongly dismissed. Freedom urges the Commission to correet the record, contim that Freedom timely has satisfied itsregulatory fee obligations, and reinstate the Application. * The 82665625 amount purportedly due the Commission is comprised of the original regulatory fee of 521,325.00, plus a 25% penalty in the amount of$5,331.25. * Freedom‘s hasattempted to rectfy the Commission‘s priorinquiries sbout these payments by eters from Freedom‘s counse to the Commission dated July 30, 2002, June 12, 2003,and August 30, 2005.
