                                      Explanatory Exhibit


        The band 5850-5925 MHz is shared on a co-primary basis with the Federal Government,
which uses the band for radiolocation in the U.S. and U.S. Territories. The applicant understands
that the Department of Defense uses this band for a wide variety of radar applications including
the advanced ground-based air defense missile system. The applicant accepts that there is the
potential for unacceptable interference to this earth station’s communication links from the
Federal radiolocation systems, including high-powered land-based transportable and shipborne
radar transmitters operating in the band in accordance with footnote G2.

        Accordingly, the applicant will comply with the provisions of footnote US245 and
recognizes that this application will be subject to case-by-case electromagnetic compatibility
