LightSquared Subsidiary LLC FCC Form 312 RESPONSE TO QUESTION 35: WAIVERS The Application requests power limits and out-of-band-emission (“OOBE”) requirements that are different from those set forth in the Commission’s rules. See 47 C.F.R. § 25.253. While these limits do not exceed the limits set forth in the rules, out of an abundance of caution, a waiver is requested insofar as operations at the requested power and OOBE levels are inconsistent with the Commission’s rules.
