                         DESCRIPTION OF MODIFICATION

         By this application, Towerstream Corp. (“Towerstream”) hereby requests

approval from the Federal Communications Commission (“FCC” or “Commission”) for a

minor modification to its fixed satellite service (“FSS”) earth station located in Miami,

Florida, Call Sign KA412 (“KA412” or “License”). In 2000, as part of an agreement to

allow terrestrial operations in the 3650 MHz band and protect existing earth station

operators, the Commission afforded KA412 “grandfathered” status.1 Since that time,

operation of the License continues to be protected from harmful interference as a result of

“grandfathered” status.2 As demonstrated in the application, the requested modification

to the License will not result in a change in KA412’s grandfathered status since the

proposed modification will not: (1) increase the height of the center line of the dish; (2)

result in a change of geographical coordinates greater than one second in either latitude or

longitude; or (3) increase the likelihood of receiving interference.3 Additionally, this

minor modification does not include a request for an increased protection zone around the

proposed antenna.
