FCC Form 312 Exhibit 3 REGARDING COMPLIANCE WITH FREQUENCY COORDINATION REQUIREMENTS UNDER SECTION 25.222(c) AND (d) Telesat’s operation of the Intellian v100GX Earth Station on Vessels (“ESV”) antennas will fully comply with the requirements of Sections 25.222(c) and (d) of the Commission’s ESV regulations. Telesat notes that it has entered into a Coordination Agreement, effective June 4, 2012, between itself and the National Aeronautics and Space Administration (“NASA”) regarding Telesat’s operation of ESV’s in the proximity of any TDRSS facilities in the 14.0 – 14.47 GHz band, and specifically the 14.0 – 14.2 GHz band. Telesat certifies that it will operate the Intellian v100GX ESV units within the specified distances and thresholds established in its NASA Coordination Agreement, thus satisfying the provisions of Section 25.222(c) of the Commission’s rules. Furthermore, Telesat understands and complies with the mandates set forth in the Commission’s ESV regulation that operations of ESVs in the 14.47 – 14.5 GHz band within the distances specified for the facilities set forth in 25.222(d) are only permitted after they have been successfully coordinated through NTIA/IRAC. Telesat may in the future pursue coordination of its operations contemplated herein with NTIA/IRAC in regards to the locations specified by Section 25.222(d). Unless and until such coordination is successfully completed Telesat will comply with 25.222(d) by not operating Ku-band ESVs at all on the specified frequencies within the specified distances of the facilities set forth in those provisions.
