E100091, Kapolei, Hawaii Extension Request Request for Additional Time to Construct Allen Holdings, Inc. d/b/a Allen Communications (“Allen Holdings”), licensee of fixed transmit/receive earth station E100091 (SES-LIC-20100809-01023) at Kapolei, Hawaii, requires additional time in which to construct the facilities authorized for E100091. Allen Holdings owns certain earth station equipment, which is being leased for use at an adjacent teleport site in Kapolei, Hawaii. Those leases were in default. Accordingly, Allen Holdings applied for a license for E100091 at an adjacent site so that the customers of the adjacent teleport could be assured of continuity of service. The operator of the adjacent teleport, however, has now filed for bankruptcy and is operating in “debtor-in-possession” status. Allen Holdings’ ability to relocate its earth station equipment to the authorized E100091 site has been stayed by the bankruptcy court pending the outcome of the bankruptcy proceeding. Therefore, Allen Holdings has been delayed in constructing E100091 by circumstances beyond its control. The public interest will be served by extending the construction period for E100091 to assure continuity of service to the public.
