                                      ANTENNA WAIVER



Telesat’s proposed 2.4 meter earth station is less than the 4.5 meters required for routine
licensing. Telesat further notes that the earth station does not comply with the antenna
performance standards specified in Section 25.209, in the transmit band 5925 to 6425 MHz,
between 1.0 and 1.5 degrees.1 Outside the main beam, the antenna meets the
requirements of §25.209. Telesat’s proposed antenna will operate at RF power densities not
exceeding -16.4 dBw/4kHz. This power density into the antenna, is more than 7 dB below the
requirements stated in Section 25.220, paragraph c(1) and Section 25.212, paragraph d(2). As
a result, the proposed non-routine earth station will operate without causing unacceptable
adjacent satellites interference.

To the extent necessary, Telesat requests a waiver of Section 25.209 in order to permit
licensing of its proposed non-routine 2.4 meter earth station. The Commission may grant a
waiver for good cause shown.2 Good cause exists in this case because Telesat’s significant low
RF power density should result in acceptable antenna performance and will not cause adjacent
satellites interference.

The proposed 2.4 meter Prodelin antenna also does not meet the antenna performance
standards contained in Section 25.209 in the receive band 3700 to 4200 MHz. Telesat will,
however, accept adjacent satellite interference in this band from adjacent satellites located
1.5° - 6° away, to the extent of protection afforded under Section 25.209.
