Kathleen:

Here’s the order of events supported by documents as wells as my notes during phone
conversations with the FCC Revenue & Receivable Operations Group:

   1. Satellite Truck was sold to North American Communication on 10-15-04 and
      FCC 312- Schedule A “Consent to Transfer of Control” form was filed along with
      FCC Form 159 and $445 filing fee paid by North American Communication’s
      president Gary Oksutcik.
   2. In January of 2006, Peak Uplink received notification of outstanding Regulatory
      Fees for the call sign. I called the FCC (1-202-418-1995) and spoke with Evelyn
      who asked for supporting documents to be faxed to her and additionally suggested
      that I write to Marvin Washington, Credit Manager of the Revenue & Receivable
      Operations Group, to request that the overdue sum be cleared from our account.
   3. In August of 2007, Peak Uplink once again received a bill for collection. I called
      the above number on 9-5-07 and spoke with Judith who requested that I fax her
      the documents and she would take care of it.
   4. In June of 2008, I again received a bill for collection of the regulatory fees and
      again called the above number on 07-01-08 and spoke with Judith who said she
      had tracking numbers to deactivate the call sign (#6769 and #6966) and that this
      should take care of the problem. She said I was to ignore any further bills for that
      call sign. “This was an internal billing problem” and I “was not the only person to
      call her with this issue.”
   5. On 9-06-08, Peak Uplink received another bill for collection of Regulatory Fees
      for this call sign plus five of our six call signs for our Satellite trucks. I went on-
      line and to pay for the valid 2008 call sign fees and saw that our account had been
      “Red Lighted” for non-payment of fees for the call sign E990398. I called the
      Revenue & Receivable Operations Group and spoke with Shari who said that the
      de-activation was in their system and she didn’t know why this was happening.


   She was the first person in the past four years to suggest that I call IBFS to see if
   the problem could be fixed. I called you.
6. Additional information: The satellite truck carrying the dish with the call sign
   E99398 suffered a rollover accident and the entire truck with dish was totaled
   around Thanksgiving , 2005. North American Communication filed Chapter 11
   within the past two years, and Pres. Gary Oksutcik now runs North American
   Television.

working with you to correctly rectify this situation.
