Mr. Katonah -
I spoke this evening to your applicant, Mr. Paulino Bernal regarding his
application for a modification of E930108. (SES-MOD-19991007-01703)
Upon review, we have determined that your application is not processable for
the following reason:
E930108 is currently authorized to operate on C-band frequencies. Your
application request modification of this license to add an antenna that will
operate on Ku-band frequencies. We are unable to grant such a request. In
this situation, our Rules require that you file an application for a new
license that will be assigned a new call sign.
We thank you for filing through our IBFS system and ask that you complete a
new eform (#1 on the list of possible applications to be filed Χ Form 312 for
New Authorization) and submit a new 159 payment form with a check in the
amount of $1950.

In addition, we noticed that you listed GSTAR IV as your point of
communication for this station. GSTAR IV is a U.S. licensed satellite and is
included in the ALSAT list. You may want to consider filing for ALSAT as your
point of communication which will allow you to communication with all U.S.
licensed satellites.

With regard to the original fee payed for the modification, you may request a
refund by filing a letter to the Office of the Managing Director. (Federal
Communications Commission, Managing Director, 1-C152, 445 12th Street, S.W.,
Washington, D.C. 20554) That office will determine whether a refund is
warranted based on the cost already incurred by the Commission.
