EXHIBIT E HNS License Sub, LLC Modification of License Application Response to Question E20 September 2011 PROPOSED ANTENNA IS EXEMPT FROM FAA NOTIFICATION The proposed antenna is exempt from notification to the FAA under Section 17.14(a) of the FCC’s rules, 47 C.F.R. § 17.14(a). See also 47 C.F.R. § 25.113(c). The proposed antenna will be located in the existing Fillmore, CA teleport, and the antenna will be shielded by existing structures of a permanent and substantial character, and by natural terrain. There are several FCC-licensed earth station antennas located in the teleport at the proposed site that are at heights above ground level that are comparable to or greater than the height above ground level of the antenna proposed in the instant application, including the existing antenna under Call Sign E060383. See e.g., Call Sign E4132, Call Sign E2178. Moreover, the antenna will be located on a hillside, below the ridgeline. Under these circumstances, it is evident beyond all reasonable doubt that the proposed antenna will not adversely affect safety in air navigation.
