Dear Mr. Nalda:
On July 1, 2005, The Boeing Company (Bosing) filed the above—captioned application to modify
its existing conventional Ku—Band‘license to add. among other things,the SN—4 (Spacenct 4)
satelle at 172"EL., AMC:23 satelite at 172" EL, INTELSAT 605 satellte at 174° E.. NSS—5
satellt at 177° W.L, and AMC—6 sateliteat72" W.L., s new Points of Communication using
the conventional Ku—Band and extended Ku—Bands.® Pursuantto Section 25.1 12(a)(1) ofthe
Commission‘s rules, 47 CRR. § 25.1L2(a)(1, we dismiss this application in partas defective
because of inconsistencies in frequency bands for certain Points of Communication:
Your application requestsauthority forthis earthsttion to receive transmissions in the 12.2—
12.75 GH band from NSS—5. NSS—5, however, is not capable of transmitting in the 12.2—12.5
GHz band. Similarly,you request authority o receive trnsmissions from SN—4 in the 11.45—11.7
and 12.2—12.75 GHe bands. SN—t does not havthe capabilty or authorty to transmit in these
bands, ‘Thus, we dismissthat portion of your application that seeks authority to operate with the
NSS—5 and SN—t since we cannot determinethe frequencies on which you intend to operate
While we dismiss the application in prt on the above basis, we take the opportunity to apprise
you afother concerms we have should Bocing chooseto refilthe application.
Since your application did notinclude information similar t that required by Schedule S we
have insufficient technical information before us on which to make a determination as to whether
NSS—5‘s 12.5—12.75 GHe band operations are compatible with those ofother satelites
Therefore, if you choose to refile your application withregard to NSS—S in the 12.5—12.75 GHtz

provideinformation similar to what Bocing filed in itsprevious modifcation application (File
No. SBS—MOD—20040301—00304)to demonstrae compatibility with adjacent satelte
operations.
Accordingly, pursuant to Section 25.112(a)(1)of the Commission‘s rles, 47 CIFR. §
25.1 12(a¥(D, and Section 0.261 of the Commission‘s ules on delegations of authority,47 CER.
§ 0.261, we dismiss your applicationin partto the extent stated above without prejudice to
refiling.* We will continue o process the remaining portions of your application.
