         NewCom International,Ic.(‘NewCom"), through its undersigned counsel and pursuant
 to Section 1.46 ofthe Commission‘s Rules, 47 C.F.R. § 1.46, hereby requests an extension of
 time to file an amendment t ts pending earth station application (SES—MFS—20041206—01790,
 as amended by SES—AFS—20050114—00050) as required by Section 25.137 ofthe Commission‘s
 rules." Specificlly, NewCom secks a 60—day extension ofthe November 18, 2005 deadline."
         ‘Under the Commission‘s rules and pursuant to the Commission‘s recently released
 Orbital Debris Public Notice, arth station applicants with a pending application for
 authorization to access as a point ofcommunication a non—U.. liensed space station are
 required to amend their application to provide a narrative description ofthe space stations
 operator‘s plans to mitigate orbital debris." NewCom‘s pending earth sation application
 requests authorization to access the Express 3A Russian satelite to provide data services to
 Cubs, and, as part of ts application, NewCom included certain orbital debris mitigation
 information as Exhibit B. The Commission‘s Orbital Debris Public Notice requires applicants,
 such as NewCom, to include additionalinformation in is application. Accordingly, NewCom
 intends to amend ts application to provide the required narative description

         As noted in NewCom‘s application, NewCom does not own or operate the Express 3A
satelite. Therefore, it does not have readily available the required orbital debris mitigation
information, but must instead seek such information from the Russian Rederation Govemnment.
NewCom is working dligently to obtain the requisite information and, in fact, will be in Russia
this week as part ofthese efforts. NewCom is coordinating with the Russian Federation to obtain
an English language version ofthe Russian debris miigation rules, and any other information
required by the FCC that might not be contained in those rules. Obtaining such information,
however, can be a time—consuming process and, at this time, NewCom is uncertain whether it
willhave all the information it needs from the Russian Federation by November 18, in order to
amend it application as required by the Commission‘s rules. Therefore, NewCom respectfully
requests a 60—day extension to submit the space station operator‘s plans to mitigate orbital debris.

                        FOR EXTENSION OF TIME TO FILE
                       ORBITAL DEBRIS MITIGATION PLANS

       On November 14 and 18, 2005, NewCom International, Inc. ("NewCom*) and
MCL, Inc. (°MCT")filed separate requests to waive the November 18, 2005, deadline to
amend their pending applications by disclosing the orbital debris mitigation plans for
their space segment, as required by the Commission‘s rules." Both waiver requests
involve the obtaining and submission ofthe orbital debris mitigation plans for the
Express—3A spacccraft, licensed under the administration ofthe Russian Federation and
operated by the Russian Satellite Communications Company.
        We find that, in this instance, the public interest warrants waiver ofthe
amendment deadline and an extension of time to file the orbital debris mitigation plans
for the Express3A spacecraft. Although MCI and NewCom request different time
periods for the extension, we will grant an identical 60—day extension period to both
parties because they are similarly stuated.
        Accordingly, MCI and NewCom will have 60—days from the deadline (thatis,
until January 17, 2006) to file an orbital debris amendment in the above—captioned files.
Failure to file an amendment within this time period will result in the dismissal ofthe
underlying applications.
