Dear Mr. Majetich:

        On February 2, 2016, you filed the above—captioned application for a license to operate a
12/14 GHz VSAT Network to "provide voice and data communications for oil and gas mining
operations in remote parts of West Virginia." Pursuant to Section 25.112(a)(2), we dismiss the
application as defective without prejudice to re—filing.‘

       Section 25.112 of the Commission‘s rules, 47 C.F.R. §25.112, requires the Commission to
return, as unacceptable for filing, any earth station application that is not substantially complete,
contains internal inconsistencies, or does not substantially comply with the Commission‘s rules.
Your application is not substantially complete and thus does not comply with the
Commission‘s rules.

       Pursuant to 47 C.F.R. § 25.115, all applications shall be filed electronically on FCC Form 312,
Main Form and Schedule B, and include the information specified in Section 25.130 of the
Commission‘s rules. Your application did not include a Schedule B and other supporting
documentation required to be considered substantially complete and acceptable for public notice.

 If David J. Majetich refiles an application in which the deficiencies identified in this letter have been
corrected but otherwise identical to the one dismissed, he need not pay an application fee. See47 C.F.R. §

       Accordingly, pursuant to Section 25.1 12(a)(1) of the Commission‘s rules, 47 C.F.R. §
25.112(a)(1) and Section 0.261 of the Commission‘s rules on delegations of authority, 47 C.FR. §
0.261, we dismiss these application without prejudice to re—filing.
