Dear Mr. White:

         On September 15, 2015, Denali 20020, LLC ("Denali 20020") filed the above—
captioned application for a license to operate a fixed earth station with (1) Intelsat 23 (S2831)
at 53 degrees W.L.; (2) Intelsat 25 ($2804) at 31.5 degrees W.L.; and (3) the "Permitted Space
Station List" satellites‘ in the 10.95—11.2 GHz and 11.45—12.2 GHz (space—to—Earth), and 14.0—
14.5 GHz (Earth—to—space) frequency bands. Pursuant to Section 25.112(a)(1) ofthe
Commission‘s rules, 47 C.F.R. §25.112(a)(1), we dismiss the application as defective
without prejudice to re—filing."

         Section 25.112(a) ofthe Commission‘s rules requires the Commission to return, as
unacceptable for filing, any earth station application that is not substantially complete,
contains internal inconsistencies, or does not substantially comply with the Commission‘s
rules." For the reasons set forth below, we find Denali 20020‘s application is unacceptable
for filing. Specifically:                                  '

         e    Intelsat 23 (S2831) and Intelsat 25 ($S2804) are not authorized to operate in 10.95—
              11.2 GHz frequency band, as you have requested.
         e    The "Permitted Space Station List" points of communication are only authorized
              for operations in "conventional" frequency bands.* Therefore, your request to
              communicate with Permitted List satellites in the 10.95—11.2 GHz and 11.45—12.2
              GHz frequency bands is inconsistent with the Commission‘s rules.

    Accordingly, pursuant to Section 25.112(a)(1) of the Commission‘s rules, 47 C.F.R.
§25.112(a)(1), and Section 0.261 of the Commission‘s rules on delegations of authority, 47
C.F.R. § 0.261, we dismiss Denali 20020‘s application.
