Dear Mr. Jazzo:

        On September 18, 2015, Calhoun Satellite Communications Inc. (Calhoun) filed the
above—captioned application for a license to operate a temporary—fixed earth station at various
U.S. locations with Permitted List satellites in the 3625—4200 MHz and 11700—12200 MHz
(space—to—Earth), and 5925—6425 MHz and 14000—14500 MHz (Earth—to—space) frequency bands
using a 2.4—meter antenna. Pursuant to Section 25.112(a) (1) and (2) we dismiss the application
as defective without prejudice to re—filing. ‘

         Section 25.112 of the Commission‘s rules requires the Commission to return, as
unacceptable for filing, any earth station application that is not substantially complete, contains
internal inconsistencies, or does not substantially comply with the Commission‘s rules, 47 C.F.R.
§ 25.112. The deficiencies are as follows:

    1.    Authorizations to operate with Permitted List satellites may be granted only in cases
         where the earth station operates consistent with the technical requirements of Part 25.2
         Section 25.212(d)(1) of the Commission‘s rules, 47 C.F.R. § 25.212(d)(1), establishes a
         set of routine licensing criteria for the 3700—4200 MHz and 11700—12200 MHz (space—to—
         Earth), and 5925—6425 MHz and 14000—14500 MHz (Earth—to—space) frequency bands.
         This application does not meet the antenna size and input power criteria, nor has it
         demonstrated compliance with the off axis EIRP density envelope criteria of Section
         25.218 of the Commission‘s rules, 47 C.F.R § 25.218.

    2.   Section 25.130(a)(1) of the Commission‘s rules, 47 C.F.R. § 25.130(a)(1) requires that
         applications list specific frequency bands and satellites to be used. Calhoun‘s application

          satellites operating in the conventional C, Ku and in portions of the 20/30 GHz frequency
          bands." The Permitted List does not include satellites operating in the 3625—3700 MHz
          frequency band. Accordingly, Calhoun must identify which specific satellites its earth
          station will communicate with in the 3625—3700 MHz frequency band.

          Though not a reason for dismissal, please provide the following information in any re—
filing.

          1.A manufacture‘s certificate of compliance with the technical criteria of 47 C.F.R. §§
            25.209 or 25.218 of the proposed 2.4 meter antenna operating in the 3700—4200 MHz
            and 5925—6425 MHz frequency bands.

          2.   Confirmation that the requested operations in the 3625 MHz—3700 MHz frequency
               band will be on an unprotected basis.

          3.   Demonstrations and certifications required by 47 C.F.R. § 25.220(d).

      . _Accordingly, pursuant to Section 25.112(a)(1) of the Commission‘s rules, 47 C.F.R.
§25.112(a)(1), and Section 0.261 of the Commission‘s rules, 47 C.F.R. §0.261, we dismiss the
application without prejudice to re—filing.
