        Non-Routine Earth Station Antenna Compliance and Coordination Statement


Use of Non-Routine Antenna Previously Approved by FCC

         In this application, BFI Licenses, LLC (“BFI”) is requesting authority to operate a

2.4 meter transportable Earth station manufactured by AvL Technologies. Pursuant to the

Commission’s Public Notice, International Bureau Establishes Website for List of Previously

Approved Non-Routine Earth Station Antennas, 24 FCC Rcd 2297 (2009) (“NRESA Public

Notice”), Earth station applicants proposing to use an antenna that has previously been licensed

with the same operating parameters are no longer required to attach antenna radiation plots as an

exhibit to their applications, as otherwise would be required by Section 25.132(b)(3) of the

Commission’s Rules. Instead, such applicants “need only provide an attachment to their

applications citing the particular non-routine Earth station antenna they plan to use, and an

application file number and call sign of a license in which that type of non-routine antenna has

been approved.”1

         The type of 2.4 meter AvL Technologies antenna proposed for use by BFI was previously

authorized for use with Permitted List satellites by Relay House Inc. in FCC File No. SES-LIC-

20051017-01413 (Call Sign E050290) based on a showing under Section 25.132(b)(3).2 BFI

intends to offer the same kinds of services as the antennas previously licensed to Relay House

and Peak Uplink with the same or substantially similar operating conditions. Under these

circumstances, BFI is not required to provide the antenna radiation plots otherwise required by

Section 25.132(b)(3).


Coordination Statement

       The applicant certifies that it is familiar with Parts 25 and 101 of the Commission’s rules

with respect to frequency coordination, including Section 25.130(b) of the Rules stating that a

frequency coordination analysis must be submitted with all Earth station applications. This

application, however, seeks authority to operate a temporary-fixed C-band Earth station that will

operate at various locations throughout the United States and its territories, and no initial

operating location has been identified at this time. Accordingly, no advance coordination exhibit

is required for this application, provided that the applicant certifies that it will comply with all

prior coordination requirements at each operating location. See 47 C.F.R. § 25.277(f)(2). The

applicant therefore certifies that it will perform an analysis and notification to all potentially

affected carriers prior to transmitting at each temporary location. See 47 C.F.R. § 25.277(d).

Copies of all such coordination notices will be forwarded to the FCC Operations Center Office in

Columbia, Maryland, as required by Section 25.277(c) of the FCC’s Rules. See 47 C.F.R.

§ 25.277(c).
