Dear Mr. Albright:

        On February 19, 2014, University of Alaska Fairbanks filed the above—captioned application
seeking authorization to operate a fixed earth station in Fairbanks, AK, in the 2025—2120 MHz (Earth—to—
space) frequency band and in the 2200—2400 MHz and 8000—8500 MHz (space—to—Earth) frequency bands.
Pursuant to Section 25.112(a)(1) of the Commission‘s rules, 47 C.F.R. § 25.112(a)(1), we dismiss the
application, without prejudice to re—filing.‘

          Section 25.112 of the Commission‘s rules, 47 C.F.R. § 25.112, requires the Commission to
return, as unacceptable for filing, any earth station application that is not substantially complete, contains
internal inconsistencies, or does not substantially comply with the Commission‘s rules. For the reasons
stated below, University of Alaska Fairbanks‘ application is unacceptable for filing and subject to
dismissal.

      +   University of Alaska Fairbanks did not submit a radiation hazard study, as required by item
           28 of Form 312 and Section 1.1307(b) of the Commission‘s rules, 47 C.F.R §1.1307(b).

      *   University of Alaska Fairbanks incorrectly indicated in its response to item E17 of the
          Schedule B to Form 312 that a frequency coordination report was not required.

      +   University of Alaska Fairbanks did not list a point of communication in Item E21 of the
           Schedule B to Form 312.

     +    University of Alaska Fairbanks did not list the antenna gain for the receive frequency in Item
          41/42 of the Schedule B to Form 312.

     +    University of Alaska Fairbanks‘ response to Item 24 of Form 312 was inconsistent with its
          response to Item 43/44 of the Schedule B to Form 312. Item 24 indicated, "Frequency
          Lower: 2025 Frequency Upper: 2120" MHz, while Item 43/44 of Schedule B to Form 312
          indicated a frequency band of 2025—2110 MHz.


‘ If University of Alaska Fairbanks re—files an application in which the deficiencies identified in this letter have
been corrected, but is otherwise identical to the one dismissed, it need not pay an application fee. See 47
C.F.R.§ 1.1111(d).

     +   University of Alaska Fairbanks did not include all frequencies and required operating
         parameters in Items E43 to E50 of the Schedule B to Form 312 for all frequency bands
         described in Item 43 of Form 312.

     _   University of Alaska Fairbanks provided an improper emission designator, "2G03", in Item
         E47 of the Schedule B to Form 312. Sections 2.201 and 2.202 of the Commission‘s rules 47
         C.F.R.§§ 2.201 and 2.202, define the format and content of acceptable emission designators.

     +   University of Alaska Fairbanks did not submit a Frequency Coordination and Interference
         Analysis Report for the use of 2025—2120 MHz, 2200—2400 MHz, and 8000—8500 MHz
         frequency bands as required by rule Section 25.203(c) of the Commission‘s rules, 47 C.F.R.
         §25.203(c).                                                                                —

         University of Alaska Fairbanks did not complete the frequency coordination data in items
         E51— E6O of the Schedule B to Form 312.

     Accordingly, pursuant to Section 25.112(a)(1) of the Commission‘s rules, 47 C.F.R. § 25.112(a)(1),
and Section 0.261 of the Commission‘s rules on delegations of authority, 47 C.F.R. § 0.261, we dismiss
University of Alaska Fairbanks‘ application, without prejudice to re—filing.
