Dear Mr. Duwall:

On December 19, 2011, West Virginia University filed the above—captioned license application for a
Fixed Satellite Transmit/Receive earth station. For the reasons stated below, we dismiss the
application as defective.

Section 25.112 of the Commission‘s rules, 47 C.F.R. § 25.112, requires the Commission to return
as unacceptable for filing any earth station application that is not substantially complete, contains
internal inconsistencies, or does not substantially comply with the Commission‘s rules. The West
Virginia University application has the following deficiency, which renders the application
unacceptable and subject to dismissal:

Section 25.130(a) of the Commission‘s rules, 47 C.F.R. §25.130(a) requires applications for a new
or modified transmitting earth station facility to be submitted on FCC Form 312, and associated
Schedule B, accompanied by any required exhibits. West Virginia University did not submit a
Schedule B.

In light of the above, pursuant to Section 25.112(a)(1) of the Commission‘s rules, 47 C. F. R.§
25.112 (a)(1) and Section 0.261of the Commission‘s rules on delegations of authority,47 C.F.R.
§0.261, we dismiss the referenced application without prejudice to re—filing.
