          As I indicated in my voice mail to you, on behalf of Blue Marble Networks, we have been in
          contact with the NSF representative for NTIA’s IRAC to ensure proper protection of the radio
          observatory site in Mauna Kea by Blue Marble’s proposed ESV operations who is copied on this
          email. Through this email, Blue Marble clarifies how it will operate its ESV network.
          Specifically, Blue Marble agrees to NSF’s request that it turn off the Blue Marble ESV
          transmitters in the 14.47-14.5 GHz band whenever its hosting ship platforms come within 125
          km of Mauna Kea. Blue Marble also certifies that its terminals are capable of shutting off in the
          14.0-14.2 GHz band automatically.

             I think that a statement in the amendment narrative, to the effect that Blue Marble will not
             operate in the upper 30 MHz (14.47‐14.5 GHz) of the band when within 125 km of Mauna Kea,
             would be more appropriate. It seems to me that Blue Marble should be able to operate at lower
             frequencies when close to Mauna Kea and it would avoid the need to coordinate through the
             IRAC.

                   This afternoon, on behalf of Blue Marble Network, LLC, we filed an
                   amendment to its pending ESV application as well as a revised
                   application for special temporary authority for it to conduct beta testing
                   prior to the grant of the permanent application. The amendment and
                   the STA along with the accompanying filing receipts are attached.
                   The amendment and the revised STA reflect our discussions with
                   Hsing and the power levels have been revised to reflect appropriate
                   and consistent levels. Please let us know if you have any questions.
