As I indicated in my voice mail to you, on behalf of Blue Marble Networks, we have been in contact
with the NASA representative for NTIA’s IRAC to ensure proper protection of the TDRSS Guam site
by Blue Marble’s proposed ESV operations who is copied on this email. Through this email, Blue
Marble clarifies how it will operate its ESV network. Specifically, Blue Marble agrees to NASA’s
request that it turn off the Blue Marble ESV transmitters in the 14.0-14.2 GHz band whenever its
hosting ship platforms come within 125 km of NASA’s Guam terminal located at 13.5881 N/144.8410
E. Blue Marble also certifies that its terminals are capable of shutting off in the 14.0-14.2 GHz band
automatically.

        I took a quick look at the Blue Marble service areas that were included in the information you sent me.
        The results indicate that only your South Pacific beam has the potential to provide service to areas within
        125 km of our TDRSS Guam site. It may be possible for us to come to a quick agreement if you can agree
        to turn off the Blue Marble ESV transmitters whenever their hosting ship platforms come within 125 km
        of our Guam terminal which is located at 13.5881 N/144.8410 E (decimal degrees). An example of the
        turn‐off area is illustrated in the atch.

        Let me know if Blue Marble is willing to agree to this solution. Thanks.

                   This afternoon, on behalf of Blue Marble Network, LLC, we filed an amendment to its pending
                   ESV application as well as a revised application for special temporary authority for it to
                   conduct beta testing prior to the grant of the permanent application. The amendment and the
                   STA along with the accompanying filing receipts are attached. The amendment and the
                   revised STA reflect our discussions with Hsing and the power levels have been revised to
                   reflect appropriate and consistent levels. Please let us know if you have any questions.
