43. Description. (Summarize the nature of the application and the services to be provided). Sirius Satellite Radio Inc. seeks a new earth station authorization. The three antennas of this earth station will to be used (1) as a back-up for the satellite radio program uplink currently provided from Sirius' earth station in Vernon Valley, New Jersey; (2) for TT&C back-up on the existing and future Sirius non-geostationary satellite constellation; and (3) to provide back-up services to the planned Sirius FM-5 satellite.

The Applicant waives any claim to the use of any particular frequency or of the electromagnetic spectrum as against the regulatory power of the United States because of the previous use of the same, whether by license or otherwise, and requests an authorization in accordance with this application.
