Stevenson New Jersey Public Broadcasting Authority 1233 20" Street, N.W., Suite 610 Washington, D.C. 20036—7322 Re: Call Sign: E080160 File No. SES—LIC—20080702—00884 Call Sign: EO80149 File No. SES—LIC—20080625—00849 Dear Mr. Stevenson: On June 25, 2008, and July 2, 2008, New Jersey Public Broadcasting Authority filed the above— captioned applications to operate two Temporary—Fixed earth stations in the conventional Ku— Band.‘ For the reason discussed below, we dismiss the applications, as defective, without prejudice to refiling." Section 25.112 of the Commission‘s rules, 47 C.F.R. § 25.112, requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission‘s rules. New Jersey Public Broadcasting Authority‘s applications are incomplete, which renders them unacceptable and subject to dismissal. The deficiency is as follows: New Jersey Public Broadcasting Authority did not respond to items E43—E60 of Schedule B of each of FCC Form 312 regarding the specific frequency bands, antenna polarization, emission designators, maximum EIRP per carrier, maximum EIRP density per carrier, modulation and services, elevation and azimuth angles, satellite arc, and maximum EIRP density toward the horizon. 1 11.7—12.2 and 14.0—14.5 GHz. * If New Jersey Public Broadcasting Authority refiles an application identical to the ones dismissed, with the exception of supplying the missing information, it need not pay an application fee. See 47 C.F.R. § 1.1109(d).

Federal Communications Commission DA 08—1667 Accordingly, pursuant to Section 25.112(a)(1) of the Commission‘s rules, 47 C.F.R. _ §25.112(a)(1), and Section 0.261 of the Commission‘s rules on delegations of authority, 47 C.F.R. §0.261, we dismiss these applications filed by New Jersey Public Broadcasting Authority.
