              Dear Ms. Dortch:

                              ViaSat, Inc. ("ViaSat") makes this submission pursuant to the condition in
              paragraph 28(k) of the order granting ViaSat a license to operate a network of Ku—band aircraft
              earth station terminals (the "License").‘ That condition requires ViaSat to file a report, 12
              months after commencing commercial operation, regarding the aggregate off—axis radiation
              performance of ViaSat‘s aeronautical mobile satellite service ("AMSS") system.

                              Since commencing commercial operations on November 14, 2008, ViaSat‘s
              operation of the AMSS system under the License has been very limited. ViaSat has been
              actively marketing its AMSS service. However, due to the economic down—turn and the
              significant time lag between sales of aircraft and equipment installation, ViaSat has been unable
              to collected a meaningful amount ofdata on the system performance.

                             ViaSat currently has pending a request to modify the License to add a new
              antenna model and to add points of communication." ViaSat anticipates that operations under
              the License will increase after that modification is granted.
