Dear Mr. Diamond:
On October 28, 2005, Board of Govemors of Missouri State University (Missouri State
Universiy) fled the above—captioned appliction for a lcense for a6.1 meter receive—only earth
station i the Ku—Band that will communicate with he AMC—3 satelit at 87° W.L. Pursuant to
Section 25.112(a)(1) f the Commission‘s rules, 47 CFR. §25.1 12(01), we dismiss this
applicationas defective without prejudice to refling
Specificlly,in the 312 Main Form, in response to question 24 regarding the frequency bands,
this application indicatesthat only the 12/14 GH bands (Ku Band) will be used. In Schedule B
of Form 312, the application does not the include required information for a receive—only eath
station regarding the specific frequency bands,emission designator,nor the Antenna Polarization
(question E43through ©47). Withoutthisinformation,the appliationis incomplete.
However,i your proposed earth station is intended to receive only in the 11.7—12.2 GHz band
and the only pointof communication is the U.S—licensed AMC:3 satelite,the station does not
need t be licensed to operate." Therefore, although we dismiss this application, Missouri State
University may receive trnsmissions from the AMC:3 satelteat 87" W.L. in the 11.7—12.2GHtz
band with this earth station in accordance with our rules in 47 CFR. § 25 without any further
authorization from the Federal Communications Commission.

Accordingly, pursuant to Section 25.112(a)(1)of the Commission‘s rules, 47 CRR.
§25.112a)(1), and Section 0.261 of the Commission‘s rules on delegations of authority, 47
CFR. §0.261, we dismiss this application as defective without prejudicet reiling."
