This application seeks authority to operate two new nine meter Ku−band earth stations located at EchoStar’s Cheyenne, Wyoming earth station facility. The antennas will be used to transmit programming and for various other two−way communications with Ku−band satellites (ALSAT), including the ANIK F3 space station licensed by Industry Canada to be CERTIFICATION The Applicant waives any claim to the use of any particular frequency or of the electromagnetic spectrum as against the regulatory power of the United States because of the previous use of the same, whether by license or otherwise, and requests an authorization in accordance with this application. EchoStar has provided the information specified in 47 C.F.R. 25.137 for ANIK F3 at 118.7 in SES− LFS−20040831−01253 and for AMC−16 at 118.75 in the amendment application for SES− LFS−20040831−01253 filed concurrent with this application. 18
