Hi Trang,

I spoke with the Wildblue engineers. They are do not use CDMA. They use a
TDMA/FDMA scheme and therefore used "N=1" in their calculations. Also, on each
of the graphs the amount below the 25.138 limit is noted in dB. Is this
sufficient? If not, I can get a letter from WildBlue stating clearly that all
Section 15.138(a) criteria are met. Please let me know as soon as possible the
best way to proceed as the WildBlue guys are anxious. Thanks!

  Hello Mr. Ladson,
  The above-captioned application is currently under review. Staff's review of
the application has revealed that there was no mentioned of what kind of
multiple access scheme (e.g. CDMA, TDMA, or FDMA) that the network will use in
relation to 47 C.F.R. section 25.138. In addition, the exhibit Section V of the
application contains graphs on the proposed antennas co-polarized pattern may
not have taken into consideration the multiple access scheme for the 500,000
units of the fixed satellite service. If the system is a CDMA system, the plots
on the submitted antenna off-axis EIRP spectral density may be affected.

  If the multiple access scheme is CDMA, please submit an amendment to contain
the correct graphs of the off-axis EIRP spectral density for the proposed
multiple access scheme for further review taking into consideration the 500,000
units of simultaneous users. Pursuant to Section 25. 138(a)(1), it states
"...the θ is the angle in degrees from the axis of the main lobe; for
systems where more than one earth station is expected to transmit simultaneously
in the same bandwidth, e.g. CDMA systems;   the N is the likely maximum number
of simultaneously transmitting co-frequency earth stations in the receive beam


of the satellite; N=1 for TDMA and FDMA systems." Also, please state whether
the proposed operation meets the off-axis EIRP density criteria of Section
25.138(a).

  Please submit the necessary information within 14 days business days of the
date of this e-mail. Failure of the applicant to submit the necessary
information within this time will result in the dismissal of the application
pursuant to 47 C.F.R. 25.112(c ).
