     Dear Mr. Michalopoulos:
     On December 1, 2004, EchoStar Satllite L LC. (‘EchoStar®)filed the above—captioned
     application for authorityto operate a Ka—Band" VSAT network earth station in Atlanta,Georgia.
     On February 25, 2005, EchoStar filed an amendment t this application*. For the reason
     discussed below, we dismiss the application,as amended, as defective, without prejudice.
     Section 25.1 15(of the Commission‘s rules provides that "TAJpplications to Heense individual
     earth station operating in the 20(30 GHz band shall be filed on FCC Form 312, Main Form and
     Schedule B, and shallalso include the information describe in Section 25.138." A review ofthe
     application has revealed that EchoStar filed to submitthe radiation patterms required by Section
     25.13800).

     Accordingly, pursuant to Section 25. 12(a¥(1and Section 0.261 of the Commission‘s rules,
     EchoStar‘s application, as amended, 19 DISMISSED as defective, without prejudice to refiling*.
