Dear Mr. Goldberg:
        On April 28, 2004, Gilbarco, Inc., (Gilbarco) filed an application for authority for
a Ku—Band VSAT Earth Station in Greensboro, North Carolina to communicate with the
ANIK E2R satellite at 111.1 ° W.L. and the ANIK F2 satellte also at 111.1° W.L. In
order to facilitate review of the application, we request Gilbarco to amend itsapplication
by September 20, 2004 to address the issues detailed below:

        "The application indicates that the earth station will be part ofan existing Canadian
VSAT network and will communicate via the ANIK E2R satellite with the Network Hub
located at Telesat Canada‘s Toronto, Ontario Teleport. To further process the
application, the Commission requires Gilbarco to supply the name, address, and
telephone number of a point of contact located in the United States." The point of contact
must be available twenty—four hours per day, seven days per week. If the authorization is
granted, the contact must possess the authority and the capability to terminate operations
on the earth station.

        Also, the value for EIRP density of— 17.56 dBW/AKHz entered for the emission
308KGIW in Items E49 of Schedule B is substantially lower than and inconsistent with
the mathematically minimum possible value of 26.14 calculated by subtracting the
bandwidih of the emission divided by 4 KHz after conversion to dB, from the EIRP of
47 dBW. Please correct thisinconsistency in the amendment.

        If Gilbarco does not file this amendment by September 20, 2004, the Commission
will dismiss the application pursuant to Section 25. 12(c) of the Commission‘s rules. 47
