ORBIMAGE Inc 21700 Atlantic Blud Dulles, VA 20166 Re:— Call Sign: E40109 SES—LIC—20040226—00287 ORBIMAGE Inc ("Orbimage") Dear Mr. Warren: On February 26, 2004, Orbimage filed the above captioned application for authority to operate a temporary—fixed receive—only ground station in the $025—8400 MHz band. We note that in the cover letter of your application you indicate that Orbimage would accept any harmful interference received from other Commission licenseesor authorized government users. In this regard since the application requests authority solely for receive—only operations and on an unprotected basis, we do not see any reason to license this earth station and you may receive in the 8025—8400 MHz band from U.S. Licensed Satellites without further Commission authority with the understanding that operations are on an unprotected basis. We also note that in the attachment to Item E10, you indicate that subject to receipt of all necessary licenses or approvals from U.S. and foreign regulatory authorities, Orbimage may lease this earth station on a temporary basis for use outside the U.S. The Communications Act does not reguire licensing of temporary fixed earth stations for operations outside the United States unless transmitting from a vessel oaircraft of the United States.
