43. Description. (Summarize the nature of the application and the services to be provided). Norlight Telecommunications, Inc. (Norlight) seeks a license to operate a Domestic Satellite Fixed Earth Station that will be used in the provision of video services. Please note that Norlight has been using an earth station identical to the one proposed herein (Call Sign E5401) pursuant to authority granted in File No. SES-MOD-20020311-00305. However, it has only recently come to Norlight's attention that the license for E5401 had expired and that Norlight had inadvertently allowed the license to lapse. The Commission granted a request for special temporary authority to operate during the pendency of this request for a new license. (FCC File No. SES-STA-20030624-00887).Freq. Ex.
CERTIFICATION
The Applicant waives any claim to the use of any particular frequency or of the electromagnetic spectrum as against the regulatory power of the United States because of the previous use of the same, whether by license or otherwise, and requests an authorization in accordance with this application. The applicant certifies that grant of this application would not cause the applicant to be in violation of the spectrum aggregation limit in 47 CFR Part 20. All statements made in exhibits are a material part hereof and are incorporated herein as if set out in full in this application.
