To Whorn It May Concem:

This letrer certifics that PanA mSar Corp. ("PAS") is aware that Peak Uplink, Iu/c. {PU1) is seeking
authorization to communicate with Galaxy NC at 95 degrees WL..., Galaxy/IVR at 98 degrees
W.L. and Galaxy XI at 91 degrees W.L. using 2.4 meters C—band antenna that are not strictly
comply with the FCC reguiation for off—axis sidelobe gain‘.
Accortding to the Pesk Uplink application (SES—LIC—20030702—00013), the C—band antennia is an
AVL Model 2400 with ar aperture of 2.4 meters. PAS understands that this antenna generally
exhibits non—compliance performance in the region from 1.0 to (.6 degrees off—axis from the            _
maximirm gain. The anteana cormplies at 1.6 degrees and beyond with the requirements of
§25.209 of the FCC rules.

In order to prevent poterntial unacceptable interference from antenna misalignment,. PUI will align
the 2.4 meters antenna to less than or equali to 0.5 degrees offset in the azimuth direction of the
intended satellite, In addition, UPI will reduce the transmitter power density level into the
antennsg flange to less than or equal to —10 JBW/AkHz for the low capacity 51K2G7W carrier, —14
dBW/AkHz for the 36MO0CFW cardiex, and no more than —10 dBW/MkHz for other carriers.

PAS acknowledges that the use of the AVL 2.4—m and following the above installation and
operating conditions by PUI should not cause unacceptable interfrrence into adjacent satellites in
accordance with FCC‘s 2—degree spacing policy and PUI wiil accept interference from adjacent
satellites to the degree to which harmful interference would not be expected to be caused to an
carth station employing and antenaa conforming to the reference patterns defined in §25.209 of
the FCC mules.

+/« 6 degrees orbital spacing from Oalaxy IMIC at 95 degrecs W.L., Galaxy TVR at 99 degrees
W.L. and Galaxy XI at 91 degrees WL..

            interference from adjacant sutellites t the degree to which harmful Interlerence would
            not be axpested to be caused io an sarth statlen® amploying and anterina conforming to
            tho rafelance pattarns defined in §25.209 of the FCC rules. |f the use of this antenna
            should cause Interference into other systems, PUI has agreed that t wil terminstie
            transmissi¢ns imrmnadiataly upon notice from the afacted parties.
