Re:        AvL Technologies’ application (SES-LIC-20030602-00727) and Special Temporary Authority
           (SES-STA-2003061800862) to operate a 1.0-meter, 0.96-meter, and 0.75-meter Ku-band antennas
           via ALSAT.

Dear Mr. WHETSTONE:

Upon examination of the above-referenced application, we find that additional information is necessary
before processing may continue. We request that AvL Technologies provide the following information:

      1.   The answers to question B8, page 5, Schedule B, FCC 312 for the 1.0-meter, 0.96-meter, and
           0.75-meter Ku-band antennas are “NO”, please provide as an exhibit, a technical analysis showing
           compliance with two-degree spacing policy.

      2.   Please provide the "antenna gain patterns" including co-polarization and cross-polarization for the
           proposed 1.0-meter, 0.96-meter, and 0.75-meter Ku-band antennas. We would like to obtain the
           manufacturer's range test plots of the antenna performance for three frequencies (14000 MHz,
           14250 MHz and 14500 MHz for transmit and 11700 MHz, 11950 MHz and 12200 MHz for
           receive). These plots should provide details between 0 to 9 degrees. Additionally, the plots
           should indicate the envelope defined under Section 25.209.

      3.   The proposed 1.0-meter, 0.96-meter, and 0.75-meter Ku-band antennas do not comply with
           Section 25.209 of the Commission's rules. The operation of the proposed earth stations may cause
           potential for harmful interference into the adjacent satellites as far as six degrees away from
           ALSAT. ALSAT satellite operator shall coordinate AvL Technologies’ proposed earth station
           operations with all potentially affected adjacent satellite operators. After the completion of
           frequency coordination, please submit affidavits from all affected adjacent satellite operators. In
           addition, the point of communication should not be ALSAT; it should only specify the particular
           satellite for which the satellite operator has completed the coordination with the adjacent satellites.

Commission within 30 days of this letter does not receive the amendment, the application will be dismissed
without prejudice as defective and the filing fees will be forfeited.
