Dear Secretary Dortch:

This is in response to the letter of January 16, 2004 from Raul Rodriguez, Counsel to Maritime Telecommunications
Network, Inc. (MTN) to Roger Tinley, Vice President, Space Systems, Telesat Canada (Telesat) on this subject.

On August 1, 2003, Telesat and Satmex reached a comprehensive coordination agreement (the Agreement) for the orbital
positions for which we have been granted licences by our respective administrations. Further, on August 25, 2003 the
administrations of Canada and Mexico signed a Memorandum of Understanding (the MoU) which effects coordination
between the satellite networks of both administrations.

In Articles 2.2 and 2.3 of Annex 1 to the Agreement and in Article 2 of Appendix B to the MoU, the maximum allowable
power density at the antenna flange of a Ku-band earth station is specified. Based on the technical information appended
to Mr. Rodriguez’ letter, the power density at the antenna flange of the proposed earth station exceeds this specified
maximum by more than 10 dB. Telesat has provided to Satmex the details of our calculations which lead to this
conclusion.

The proposed earth station operation would therefore be in violation of existing coordination agreements and would cause
harmful interference to our existing and planned networks. Accordingly, we oppose the grant of MTN’s earth station
application.
