Dortch, Secretary Ref: Satellite Communication Systems, Inc (SCSI) – FRN 0005863071 SCSI received a “Notice of Witholding of Action” letter (3 pages) based upon the above referenced FRN dated 1/16/07. The withholding was based upon an SCSI application to continue operations at one of our satellite earth stations located in Florida. A copy of this FCC letter is included with this submission. SCSI acknowledges we did not understand the FCC process concerning earth stations and are now trying to correct our deficiencies with the FCC in accordance with the FCC letter. Utilizing the FCC letter, SCSI obtained copies of these invoices off the Internet. SCSI would like to state, we had never previously seen these invoices. SCSI is still not sure why the FCC did not mail these to SCSI for payment. It would be helpful to SCSI if the FCC would simply mail these invoices to our company. SCSI studied all the invoices listed in the FCC letter carefully, located all the call signs, and generated an excel spreadsheet (2 pages), which is included with this document. Almost all of invoiced call signs are satellite earth stations which SCSI has or previously provided communication circuits to the US Department of Defense. Most of these satellite antennas are or were previously located on premise at US military bases. After an examination of all of these invoices, SCSI made payment for all undisputed invoices listed on the FCC letter. SCSI paid for all of these undisputed invoices via FedEx. SCSI made payment in the amount of $7,266.11. The undisputed payments are also identified on the SCSI generated excel spreadsheet. SCSI has disputed on the remaining invoices primarily for 2 different reasons. Please find both of these classifications identified below. 1. SCSI disputes the excel spreadsheet colored red for the following reason: These earth stations were no longer operational or did not exist for the Fiscal years identified on the invoice. Under FCC Title 47 Section 25.161 “Automatic termination of station authorization” A station authorization shall be automatically terminated in whole or in part without further notice to the licensee upon subsection c, The removal or modification of the facilities which renders the station not operational for more than 90 days, unless specific authority is requested. All of the SCSI disputes colored red, were for satellite earth stations located on US military bases. SCSI has enclosed some circuit termination documentation to assist in verifying the satellite earth terminals no longer operated. The information colored red was provided by the SCSI engineering department when the satellite earth station stopped transmitting. SCSI acknowledges a bit of discrepancy between the “back up information” (which we have provided on a best effort basis) and the red text on the spreadsheet. 2. SCSI disputes the excel spreadsheet colored blue for the following reason: SCSI simply does not have enough information to determine if these invoices are applicable. There is no Fiscal year identified on the invoices and it does not clearly identify the reason for invoice. If there were more information concerning the fiscal year and description of invoice, SCSI would pay this assuming the provided information was accurate and due. SCSI seeks to have a good working relationship with the FCC. SCSI apologizes for our lack of understanding concerning the FCC regulations. Our company will strive to do better in the future.
