Dear Ms. Isme:

On August 30, 2009, Alpha Broadcasting, Inc. (Alpha Broadcasting) filed the above captioned
application for an earth station operating in the Fixed Satellite Service in the C—band and in the
Ku—band. Pursuant to Section 25.112 of the Commission‘s Rules, 47 C.F.R. §25.112, we dismiss
the application as defective without prejudice.

Section 25.112 of the Commission‘s rules requires the Commission to return as unacceptable for
filing any earth station application that is not substantially complete, contains internal
inconsistencies, or does not substantially comply with the Commuission‘s rules. Alpha
Broadcasting‘s application is incomplete, which renders it unacceptable for filing and is therefore
subject to dismissal. The deficiency is as follows:

In the application, Alpha Broadcasting did not provide information in response to items E21—E27
(Points of Communication), E28—F42 (Antenna Table), E43—E50 (Frequency Table), or E51—E60
(Frequency Coordination Table) on Schedule B of FCC Form 312. In addition, the radiation
hazard study as described in question 28 of FCC Form 312 was not included in the application.
Consequently, the application is incomplete.

Our research shows that Alpha Broadcasting filed a similarly incomplete application on
September 19, 2005. That application was dismissed by the Comumission‘s letter of September 28,
2005. See File Number SES—LIC—20050919—01276 (Call Sign EO50264). We recommend that
Alpha Broadcasting carefully review the rules for filing earth station applications and ensure that
future filings are in accordance with the rules.

Accordingly, pursuant to Section 25.112(a)(1) of the Commission‘s rules, 47 C.F.R.
§25.112(a)(1), and Section 0.261 of the Commission‘s rules on delegation of authority, 47 C.F.R.
§0.261, we dismiss your application without prejudice to refiling.
