                                      Request For Waiver


       On July 2, 2009, Rockwell Collins, Inc. (“Rockwell Collins”) acquired DataPath, Inc.

(“Datapath”) along with DataPath’s wholly owned subsidiary, SWE-DISH Satellite Systems AB

(“SWE-DISH AB”) and SWE-DISH AB’s wholly owned subsidiary, SWE-DISH Satellite

Systems, Inc. (“SWE-DISH”). At the time of that transaction, SWE-DISH applied for, and was

granted, consent for the transfer of control from DataPath to Rockwell Collins. Subsequent to

that transaction, DataPath changed its name to Rockwell Collins Satellite Communications

Systems, Inc. (“RCSCS”) and SWE-DISH AB changed its name to Rockwell Collins Sweden

AB. Rockwell Collins Sweden AB and SWE-DISH remained wholly owned subsidiaries of

RSCSC.

       On January 22, 2010, Rockwell Collins Sweden AB sold its shares of SWE-DISH to

RCSCS. On January 25, 2010, SWE-DISH then merged into RCSCS, with RCSCS surviving.

As a result of those transactions, the satellite earth station authorizations held by SWE-DISH

were assigned to RCSCS.

       Due to an oversight, SWE-DISH and RCSCS neglected to request consent from the

Commission for this pro forma assignment before it was consummated. They therefore request a

waiver of Section 25.119(a) of the Commission’s rules and respectfully request the FCC

retroactively grant consent to the pro forma assignment of those earth stations from SWE-DISH

to RCSCS. SWE-DISH and RCSCS respectfully submit that the transaction has had no adverse

effect on the communications services associated with the earth station authorizations listed in

this application, as the ultimate ownership and control of the authorizations has remained at all

times with RCSCS.
