SCRIPPS HOWARD BROADCASTING COMPANY Form 312 – EARTH STATIONS ASSIGNMENT APPLICATIONS EXHIBIT D RESPONSE TO QUESTION #35 The instant pro forma assignment application seeks the Commission’s consent to the assignment of a receive-only earth station license that resulted from an intra-company reorganization of subsidiaries of The E.W. Scripps Company at the end of 2009. The Commission gave advance consent to applications for assignment of the numerous broadcast, wireless and satellite authorizations that resulted from this corporate reorganization. See, e.g., File Numbers SES-ASG-20091214-01578 and SES-ASG-20091210-01571. However, receive-only earth station E960375--as well as transmit-receive earth stations E000598 and E010092--were inadvertently not listed on these timely-filed applications. As described in the original applications and in Exhibit E to the instant application, there was no significant change in attributable interests as a result of this corporate reorganization. The applicant regrets its omissions on the earlier applications and respectfully requests waiver of Section 25.119 of the Commission’s rules which requires advance approval for any assignment of an earth station license.
