Request for Withdrawal of Amendment — SES—AMD—20090729—00937 As the Commission is aware, on 7/29/09, the instant application ("Amendment" — File No. SES—AMD—20090729—00937) was filed requesting amendment to pending transfer of control application File No. SES—T/C—2009—0427—00522 to obtain consent for the pro forma assignment of Stations E070005, E060282 and E040367 (the "Stations") from DRS Technical Services, Inc. to DRS C3 & Aviation Company. In that Amendment, the parties advised that the Amendment had been filed because effective May 15, 2009 the engineering and logistics businesses of DRS Technical Services, Inc. (including the assets related to the Station) were spun—off to its affiliate DRS C3 & Aviation Company. Subsequent to that filing, it was determined that the Stations‘ facilities were not, in fact, transferred to DRS C3 & Aviation Company as part of such transaction and that the facilities should remain licensed to the existing licensee, DRS Technical Services, Inc. The filing of the Amendment was based on a good faith misunderstanding of the facts applicable to the spin—off. Because the facilities were not transferred as part of the spin—off, it is respectfully requested that the Amendment be withdrawn. The parties apologize for any inconvenience caused by the erroneous filing and subsequent withdrawal of the Amendment. Please note that this withdrawal of the Amendment is not intended to withdraw or in any way impact the continued processing of the pending transfer of control application under File No. SES—T/C—2009—0427—00522. It is respectfully requested that such transfer of control application continue with processing by the Commission.
