Dear Ms. Dortch:

        This letter provides notice on behalf of Row 44, Inc. (“Row 44”), pursuant to Section
1.1206(b)(2) of the FCC’s Rules, that on February 18, 2009, the undersigned counsel had a
telephone conversation with Scott Kotler, Chief of the Systems Analysis Branch, Satellite
Division, concerning the above-referenced applications. In particular, the undersigned counsel
inquired whether there was any additional information that the Satellite Division required
concerning the Test Plan that Row 44 submitted on February 6, 2009 in connection with the
request for special temporary authority (“STA”) (FCC File No. SES-STA-20080711-00928). Mr.
Kotler replied that the staff did not need any additional information at this time.

        The undersigned counsel also emphasized the importance to Row 44 of a near-term grant
of the requested STA in order to allow the Test Plan to proceed, with the objective of gathering
data concerning the actual operations proposed in its underlying license application (FCC File No.
SES-LIC-20080508-00570). Such data would then be made available to the International Bureau
as it considers final action on the license application.

        In response to a question from Mr. Kotler, counsel also confirmed that Southwest Airlines
currently planned to have up to four aircraft outfitted with the Row 44 antenna system by early
March, and that Alaska Airlines planned redeployment in the near future of its airplane on which
equipment was previously installed.
