Dear Ms. Dortch:

       On January 6, 2009, the undersigned and Peter Corea of ICO Satellite Services,
G.P. (TCO"), spoke by telephone with Robert Nelson, Satellite Division Chief,
Cassandra Thomas, Deputy Chief of the Satellite Division, and Karl Kensinger, Associate
Chief of the Satellite Division.

        In its ATC application, ICO certified that it will comply with Section
25.149(b)(2)(ii) of the Commission‘s rules, 47 C.F.R. §25.149(b)(2)(ii), requiring that
MSS ATC systems maintain a spare satellite on the ground within one year of
commencing operations. ICO clarifies that it will not commence ATC operations until
firm arrangements are in place to meet the spare satellite requirement.
