Dear Ms. Dortch:

       This letter is to include in the record of the above—referenced application
proceedings the commitment New ICO Satellite Services G.P. ("ICO") is making
regarding the out—of—band emissions from ICO‘s Ancillary Terrestrial Component
("ATC") terminals into the Radionavigation Satellite Service ("RNSS") band at 1559—
1610 MHz. In connection with discussions ICO has been involved in with the relevant
United States federal agencies, these agencies have made clear to ICO that stricter
protection levels for RNSS are desired. Therefore, ICO commits to meet the following
emission limits applicable to its ATC mobile terminals and base stations:

        *discrete out—of—band emission of less than 700 Hz bandwidth

       ICO consents to the inclusion of the emission limits stated above as a condition of
ICO‘s ATC authorization.‘

‘ 1CO did not seek waiver of the emission limits in 47 C.F.R. § 25.252(b)(3) or 47 C.ER. §
25.252(a)(7) in its ATC application. However, pursuantto the discussions described above, ICO
