                    Technologies. File No. SES—AMD—20040903—01302

     Dear Ms. Dortch:

            SWE—DISH Satellite Communications, Inc. ("SWE—DISH"), pursuant to Section
     25.154(a) of the Commission‘s Rules, hereby comments on the above—referenced amendment
     filed by AvL Technologies ("AvL").‘ As a general matter, SWE—DISH has little in the way of
     objections to the amendment per se, particularly in light of the fact that nothing significant
     appears to have been changed by the amendment. As far as SWE—DISH can tell, the amendment
     (i) changes a response to a question with regard to AvL‘s status as a representative of a foreign
     government from a "not applicable" to a "no"; and (ii) some relatively minor changes in power
     limits. SWE—DISH‘s review of the amendment, however, was made more difficult because the
     description submitted by AvL did not make clear what the proposed changes were, and created
     additional confusion by referring to attachments that apparently were not included in the
     amendment.




     *      AvL‘s amendment appeared on Public Notice in Report No. SES—00640, September 15,
     2004. Despite the fact that SWE—DISH had previously filed a Petition to Deny against the AvL
     application (so that the underlying application proceeding is "restricted"), SWE—DISH was not
     served with a copy of AvL‘s application. Presumably the amendment is a communications
     directed to the merits of this proceeding, and thus a "presentation" under the Commission‘s
     Rules. To the extent there will be other communications between AvL and the Commission
     going to the merits of AvL‘s applications (or to the extent that any such previous
     communications transpired), SWE—DISH expects to be served with copies of the documents and
     expects that the Commission‘s database will also reflect any such communications.
