TO REMOVE NAME FROM CABLE LANDING LICENSE IT&E Overseas, Inc. ("IT&E") (FRN 0001523125) hereby respectfully requests that the Commission modify the AT&T Corp. et al. cable landing license ("License") issued by the Commission on December 15, 1998, in FCC File No. SCL—AMD—19980902—00018, to remove IT&E‘s name as a licensee pursuant to Section 1.767(m)(2) of the Commission‘s rules and the Commission‘s Submarine Cable Report and Order.‘ The Guam—Philippines Fiber Optic Submarine Cable System ("G—P Cable System") extends between Guam and the Philippines. IT&E‘s ownership and voting interest in the G—P Cable System is 0.1240 percent. Guam—Philippines Cable Limited Partnership ("GPC LP") holds a 79.3899 percent ownership and voting interest in the G—P Cable System. The sole general partner of GPC LP, the Guam—Philippines Cable Company of Hong Kong, is responsible for the day—to—operation and maintenance of the G—P Cable System." ! IT&E is not required under section 1.767(h), (m)(2) the Commission‘s rules to be a licensee of the G—P Cable System and seeks to remove its name from the License (in the words of the rule to "relinguish its interest in the License"). IT&E does not own or control a cable landing station in the United States and owns or controls less than a five percent interest in the U.S. points of the G—P Cable System." Removing IT&E‘s name from the license will not affect the day—to—day operations of the G—P Cable System as the remaining licensees, which include GPC LP, "will retain dejure and de facto control of the U.S. portion of the [G—P Cable System] sufficient to comply with the requirements of the Commission‘s rules and specific conditions attached to the [LJicense."" The removal of IT&E‘s name from the License is therefore permissible under the Commission‘s rules. As required by Section 1.767(m)(2) of the Commission‘s rules and the Submarine Cable Report and Order, concurrent with this filing, IT&E will serve a copy of this application on each of the other joint licensees of the License. IT&E requests streamlined processing for this application in accordance with section 1.767(3)—(k) of the Commission‘s rules, 47 C.F.R. § 1.767(j)—(k). IT&E hereby certifies that it is not a foreign carrier and that it is not affiliated with a foreign carrier in the foreign destination market for the G—P Cable System, the Philippines.‘ 5 Accordingly, streamlined processing for this modification application is appropriate." * See 47 C.F.R. § 1.767(b). * See 47 C.F.R. § 1.167(m)(2). * As part of an asset transaction, IT&E intends, after grant of this application, to sell its ownership interest in the cable system to PTI Pacifica Inc., a carrier whose qualifications are well known to the Commission.
