                         Request for Special Temporary Authority

                ViaSat, Inc. requests special temporary authority (“STA”), for a period of 60
days commencing on or about October 19, 2011, to permit ViaSat to: (i) conduct in-orbit
testing and short-term operations of the ViaSat-1 satellite at 109.2° W.L. following the
launch of that satellite; and (ii) once such activities are complete, move the satellite to 115.1°
W.L. To the extent that ViaSat’s application for regular Commission authority to launch
ViaSat-1 and operate it at 115.1° W.L (See IBFS File No. SAT-LOA-20110722-00132, as
amended) has not been granted in time, ViaSat requests that this STA also cover the launch
of ViaSat-1 into 109.2° W.L. 1

                Currently pending before the Commission are a series of earth station
applications seeking STA to communicate with and conduct telemetry, tracking and control
(“TT&C”) related functions for ViaSat-1 during its proposed operations at 109.2° W.L. and
its subsequent drift to 115.1° W.L. See IBFS File No. SES-STA-20110526-00632; SES-
STA-20110526-00633; SES-STA-20110526-00634; SES-STA-20110526-00635; SES-STA-
20110526-00636; SES-STA-20110526-00637; SES-STA-INTR2011-04402, as amended
(“Earth Station STA Requests”). This STA seeks authority for the corresponding spacecraft
activities at 109.2° W.L. The scope of those activities, including salient technical parameters,
is described or referenced in ViaSat’s Earth Station STA Requests, which ViaSat
incorporates by reference.

                 ViaSat-1 currently is at its launch site and being readied for launch in mid-
October. ViaSat has coordinated its in-orbit testing, short-term operations, and drift, with
potentially affected satellite networks. ViaSat acknowledges that such activities may not
cause harmful interference to any other lawfully operating satellite or radio-communication
system, and that ViaSat is not entitled to claim protection from interference caused by such
satellites or systems. During the drift, only TT&C-related communications will occur.

               Grant of the requested STA would be consistent with other instances in which
the Commission has authorized similar operations. See, e.g., DISH Operating L.L.C., IBFS
File No. SAT-STA-20100219-00032 (granted Mar. 11, 2010). As further described in the
Earth Station STA Requests, the proposed operations would serve the public interest by
allowing ViaSat (i) to ensure that ViaSat-1 is fully operational before locating that satellite to
its permanent home at 115.1° W.L., and (ii) to conduct short-term operations at less than full
two-degree spacing so that the impact can be fully evaluated for purposes of developing,
coordinating, and operating broadband networks in such an environment. Accordingly,
ViaSat requests that the Commission grant the requested STA for 60 days, commencing with
the expected launch of the satellite on or about October 19, 2011.
