SAT—STA—20100625—00147 Dear Ms. De La Torre, Ms. Milkman, and Mr. Knapp: Open Range Communications Inc. hereby submits its final report regarding efforts to secure alternative spectrum pursuant to paragraph 5(b) of the Bureaus‘ Order on Reconsideration (DA 10—1001) released September 23, 2010 granting Open Range special temporary authority ("ST4 Order"). On October 6, 2011, Open Range filed a voluntary petition under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court in the District of Delaware. Since that time, no further negotiations or discussions regarding access to alternative spectrum have been held.
