(PanAmSat) for special temporary authority for a period of 30 days, commencing May 6, 2010, to conduct telemetry, tracking, and telecommand (TT&C) operations with the Galaxy 15 space station (Call Sign $2387) outside the +/—0.05° east/west station—keeping box previously authorized for Galaxy 15 is granted.‘ This authorization shall be in accordance with the technical specifications set forth in PanAmSat‘s application, Federal Communication Commission (Commission) rules, and the following conditions: 1. PanAmSat is required to accept interference from other lawfully operating space stations or radio communications systems. 2. In the event of any harmful interference to other lawfully operating space stations or radio communications systems, PanAmSat shall inform the Commission, in writing, immediately of such an event. 3. The Galaxy 15 satellite was located at the 133.0° W.L. orbital location.* As PanAmSat previously has informed the International Bureau ("Bureau") staff, on April 5, 2010 the Galaxy 15 satellite experienced an anomaly of unknown . origin. Due to this anomaly, the Galaxy 15 satellite has drifted outside of its authorized +/— 0.05° East/West station—keeping box The satellite currently is located atapprox1mately 132.60° W.L. Dortch April 30, 2010 Page 2 Where the parflcular facts make strict compliance inconsistent with the public interest.‘ In granting a waiver, the Commission may take into account considerations of hardship, ec%ulty, or more effective implementation of overall policy on an individual basis." Waiver is thereforeappropriate if special circumstances warrant a deviation from the general rule, and such a deviation will serve the pubhc interest. Good cause ex1sts in this case based on hardship. Due to the technical anomaly on the Galaxy 15 satellite, PanAmSat is unable to comply withthe requirements of Section 25.210(j) of the Commission‘s rules. PanAmSat will, however, take all practicable steps to coordinate the safe operatmn of Galaxy 15. .
