Attachment to Grant Application of PanAmSat Licensee Corp. IBFS File No. SAT—STA—20100330—00059 June 25, 2010 The application of PanAmSat Licensee Corp. (PanAmSat) for special temporary authority, IBFS File No. SAT—STA—20100330—00059, is granted in part and deferred in part. PanAmSat is authorized, for a period of 90 days beginning June 25, 2010, to conduct telemetry, tracking and telecommand (TT&C) necessary to drift its C— and Ku—band space station, Intelsat 2 (Call Sign $2459) from the 169.10° E.L. orbital location to the 157° E.L. orbital location, and to maintain Intelsat 2 at the 157° E.L. orbital location upon arrival. PanAmSat is authorized to conduct TT&C operations on the 6424.5 MHz and 5925.5 MHz (Earth—to—space) and 4198.5 MHz and 4199.5 MHz (space—to—Earth) frequencies. PanAmSat‘s request to operate the communications payload on the Intelsat 2 space station at the 157° E.L. orbital location is deferred. This authorization is granted in accordance with the terms, conditions, and technical specifications set forth in PanAmSat‘s application, the Federal Communications Commission‘s rules, and the conditions of this attachment. 1. All operations shall be on an unprotected and non—harmful interference basis, i.e., the Intelsat 2 space station shall not cause harmful interference to, and shall not claim protection from interference caused to it by any other lawfully operating station. In the event of any harmful interference, PanAmSat shall cease operations immediately upon notification of such interference, and shall inform the Commission, in writing, immediately of such event. PA PanAmSat shall coordinate its operations with existing geostationary satellites to ensure that no unacceptable interference results fromits temporary operations during the drift to the 157° E.L. orbital location. 3. During the drift to the 157° E.L. orbital location, PanAmSat will utilize only the TT&C frequencies specified above, and will operate pursuant to any existing coordination agreements for Intelsat 2. 4. PanAmSat shall timely prepare and submit to the Federal Communications Commission materials for submission to the International Telecommunication Union in connection with the operations of the Intelsat 2 space station at the 157° E.L. orbital location. 3. Grant of this authority is without prejudice to PanAmSat‘s request for special temporary authority to operate the communications payload on the Intelsat 2 space station at the 157° E.L. orbital location. 6. This grant of special temporary authority is without prejudice to any decision with respect to PanAmSat‘s replacement expectancy for the 12.25—12.75 GHz and 14.25—14.50 GHz frequency bands at the 169.1° E.L. orbital location. Further, this grant does not constitute an announcement that these frequencies are available for reassignmenit. 8. PanAmSat is afforded thirty days from the date of release of this grant to decline this grant as conditioned. Failure to respond within this period will constitute formal acceptance of the authorization as conditioned. 9. This action is issued pursuant to Section 0.261 of the Commissions rules on delegated authority, 47 C.F.R. § 0.261, and is effective immediately. ("PanAmSat") herein requests Special Temporary Authority ("STA")‘ for 90 days beginning June 1, 2010 to drift Intelsat 2 (call sign $2459) from 169.10° E.L. to 157.0° E.L. and to operate the satellite temporarily in the C— and Ku—bands at 157.0° E.L. PanAmSat subsequently will file an STA request and permanent license modification application to redeploy Intelsat 2 to another location after its temporary stay at 157.0° E.L. Intelsat 2 is curréntly operating at 169.10° E.L., * where it is collocated with Intelsat 5 (call sign $2704)." Following traffic transfer from Intelsat 2 to other Intelsat spacecraft and subject to receipt of FCC approval, Intelsat 2 will be relocated temporarily to 157.0° E.L. [ During the drift of Intelsat 2 from 169.10 ° E.L. to 157.0° E.L., PanAmSat . will utilize only the satellite‘s TT&C frequencies and will follow industry practices for coordinating TT&C transmissions during the relocation process. Dortch March 30, 2010 Page 2 Downlink: 4198.5 MHz (H, V) 4199.5 MHz (H, V) Grant of this STArequest is in the public interest because it will allow PanAmSat to conduct temporary operations at 157.0° E.L. before moving the satellite to a different location, thus ensuring maximum fleet flexibility. Moreover, because Intelsat 2 currently is collocated with Intelsat 5 at the nominal 169.0° E.L. location, the redeployment of Intelsat 2 will not result in a loss of service at that location. . Grant of this STA request will notresult in increased risk of harmful interference. As noted above, PanAmSat will operate only the above listed TT&C frequencies during the drift, and will coordinate its TT&C transmissions with operators of satellites in the drift path. Should any interference occur during the drift, PanAmSat will take all reasonable steps to eliminate such interference. Once on—station at 157.0° E.L., . PanAmSat will operate the communications payload in conformance with Intelsat‘s coordination agreements related to that location. ’ PanAmSat has assessed and limited the probability of the space station becoming a source of debris as a result of collision with large debris or other operational space stations. Intelsat 2 will not be located at the same orbital location as another satellite or at an orbital location that has an overlapping station—keeping volume with another satellite. Further, — PanAmSat is not aware of any other FCC licensed system, or any other system applied for and under consideration by the FCC, having an overlapping station—keeping volume with Intelsat 2 at 157.0° E.L. Finally, PanAmSat is not aware of any system with an overlapping station—keeping volume with Intelsat 2 at 157.0° E.L. that is the subjectof an ITU filing and that is either in orbit or progressing towards launch.
